Regulations relating to reducing wildfire hazard risk are usually found in building codes, subdivision regulations, fire codes and zoning regulations. These regulations are enacted at either the municipal or county level. Covenants, Codes and Restrictions (CC&Rs;) are rules that govern the use of land within a subdivision. The CC&R;�s are usually enforced by the Homeowners Association. CC&Rs; are rules that apply to the developer of the property and subsequent owners. CC&Rs; are filed with the deed and must be followed in perpetuity. Most commonly, CC&Rs; are associated with maintaining property values through required upkeep of the homes and yards in a subdivision. A new use of CC&Rs; is to require Firewise building practices within the subdivision and requiring residents to maintain defensible space around their homes.

Bull Lake Estates CC&Rs;

Bull Lake Estates, in Lincoln County, Montana is an example of a subdivision with firewise regulations built into its CC&Rs.; The Bull Lake Estate CC&Rs; can be viewed on the internet at http://www.bull-lake-estates.com/restrict. Included in the text are the following provisions which relate to fire safety:

10. Lot owners will comply with the Montana Fire Protection Guidelines for Wild Land Residential Interface Development in lot development. (For information on the Montana Fire Protection Guidelines, see the entry on this website.)

Section 6. Minimum Wildfire Prevention Measures:

A. Roofs of structures will be constructed of, or made to be, fire resistant material (Class A or Class B Fire Rating) and kept free of debris such as pine needles, leaves, moss, etc.

B. A thirty foot (30') perimeter will be kept around structures in which weeds, brush, and other debris capable of rapidly transmitting fire are removed.

C. No portion of a tree or any other vegetation will extend to within 25 feet of the outlet of a chimney or stovepipe.

D. Residential structures will have displayed a number indicating its address or location that can be read by emergency vehicles from at least 100 feet (numbers at least four (4) inches high and one-half inch high.)
